These Terms are governed by the laws of Western Australia and the Commonwealth of Australia, including but not limited to the Competition and Consumer Act 2010 (Cth) (incorporating the Australian Consumer Law), the Transport (Road Passenger Services) Act 2018 (WA), and the Road Traffic Act 1974 (WA).
You may access and use the Site for lawful personal or business purposes in accordance with these Terms. You must not:
Ace Charter provides bus and coach charter transport services including corporate transfers, school excursions, wedding guest shuttles, sporting event transport, tours, and private group hire across Perth and Western Australia. Vehicle availability, fleet options, and scheduling are subject to demand and operational capacity.
All charter services are operated in compliance with the Transport (Road Passenger Services) Act 2018 (WA), the Road Traffic Act 1974 (WA), and applicable national heavy vehicle and fatigue management legislation. Our vehicles are regularly maintained and our drivers hold current WA driver accreditation.
Nothing on this Site constitutes a binding offer to provide transport. Charter bookings are confirmed only upon our written acceptance of a booking request.
All bookings are subject to acceptance by Ace Charter and the availability of suitable vehicles and drivers. Pricing is confirmed via a written quote issued to the Customer.
Cancellation and amendment terms will be specified in your booking confirmation. As a general guide:
Ace Charter reserves the right to cancel or reschedule a charter due to circumstances beyond our reasonable control (including severe weather, road closures, mechanical failure, or government-imposed restrictions). In such cases, we will offer a full refund or alternative date.
Passengers must comply with all reasonable directions of the driver and must not:
The driver reserves the right to refuse boarding or remove any passenger whose behaviour poses a safety risk. The Customer is responsible for the cost of any damage to the vehicle caused by passengers.
All intellectual property rights in the content of the Site — including text, graphics, logos, and software — are owned by or licensed to Ace Charter. Nothing in these Terms grants you any right to use our intellectual property other than as permitted herein.
Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition, implied or imposed by the Australian Consumer Law (ACL) (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) that cannot be lawfully excluded or limited.
Where our services are supplied to a consumer under the ACL, you may have consumer guarantees including that services are provided with due care and skill, are fit for purpose, and are supplied within a reasonable time.
To the extent permitted by law, our liability for a breach of a non-excludable consumer guarantee is limited (at our election) to:

Ace Charter maintains comprehensive motor vehicle insurance, public liability insurance, and passenger liability insurance as required by the Transport (Road Passenger Services) Act 2018 (WA). Details of our insurance coverage are available upon request.
Each party agrees to keep confidential all non-public information received from the other party in connection with a charter booking or corporate account, and to use such information only for the purposes of that engagement. This obligation survives termination for a period of 3 years.
Either party may terminate a corporate account arrangement by providing written notice as specified in the relevant agreement. Upon termination:

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be severed, and the remaining provisions shall continue in full force and effect.
Failure by Ace Charter to exercise or enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
These Terms, together with any written booking confirmation or corporate account agreement and our Privacy Policy, constitute the entire agreement between you and Ace Charter with respect to your use of the Site and booking of our services, superseding all prior agreements, representations, and understandings.
These Terms are governed by and construed in accordance with the laws of Western Australia and the Commonwealth of Australia. You irrevocably submit to the exclusive jurisdiction of the courts of Western Australia (and any relevant appellate courts) for the resolution of any disputes arising under or in connection with these Terms.
